7) Arbitration Agreement & Class-Action Waiver
PLEASE READ: Except for eligible small claims, you and Rocketing.AI, LLC agree to resolve disputes through binding individual arbitration. You waive the right to a jury trial and to participate in a class action.
Scope
This agreement applies to any dispute, claim, or controversy arising out of or relating to the Services or these Terms, whether based in contract, tort, statute, fraud, or any other legal theory.
Small Claims Carve-Out
Either party may bring an individual claim in small claims court located in Saint Louis County, Missouri, if the claim qualifies.
Arbitration Rules & Forum
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or by another reputable administrator as mutually agreed. The arbitrator has exclusive authority to resolve disputes relating to interpretation, applicability, or enforceability of this agreement.
Filing & Fees
AAA filing, administration, and arbitrator fees will be governed by AAA rules. We will reimburse fees for non-frivolous claims as required by law.
One-on-One Arbitration Only
Claims must be brought in an individual capacity, not as a class member or representative, and the arbitrator may not consolidate claims without consent.
Opt-Out
You may opt out of arbitration by emailing info@rocketing.ai within 30 days of first agreeing to the Terms, stating your intent to opt out and providing your name and the email associated with your account.
Severability
If any part of this agreement is found unenforceable, the remaining parts remain in effect, except that if the class-action waiver is found unenforceable, the entire arbitration agreement will be unenforceable.
